Probation Failures Exposed: Missed Opportunities Lead to Tragedy

In a recent assessment, a manager rated Basil Borutski’s probation officer’s performance as meeting the target range of 95% to 100%. This evaluation came just two days after Borutski tragically murdered his two former partners, Anastasia Kuzyk and Nathalie Warmerdam, as well as Carol Culleton on September 22, 2015.

Over the preceding three years leading up to the fatal incidents in the Ottawa Valley, Borutski’s probation officers in Renfrew and Pembroke, Ontario, were responsible for ensuring the compliance of the repeat domestic violence offender with court orders following his jail term for threatening Warmerdam’s family and assaulting Kuzyk.

Despite being tasked with coordinating with various partner agencies to safeguard the victims, including Kuzyk, Warmerdam, and Borutski’s ex-wife, a subsequent death review revealed multiple missed opportunities for intervention by the probation officers.

Following the tragic murders, amidst widespread public outcry, the local manager expressed concern that Kuzyk should have been contacted on a monthly basis, despite the “target met” score being the highest achievable.

The disclosed probation and parole records shed light on multiple missed opportunities to address Borutski’s non-compliance with court-ordered programs for domestic violence offenders. Critical reviews conducted before the killings highlighted these shortcomings, where Borutski repeatedly failed to adhere to program requirements.

The newly disclosed details from Borutski’s probation file, consisting of over 400 pages, offer insight into the supervision he received. While efforts were made to assist Borutski in meeting his obligations, the failure to address his manipulative behavior and potential triggers for violence is evident.

Despite the system’s acknowledgment of shortcomings and attempts to rectify them post-inquest, there remain concerns about the efficacy of probation management and the need for continued improvements to protect victims of intimate partner violence.

Moving forward, stakeholders stress the importance of learning from past mistakes and implementing effective strategies to prevent similar tragedies, emphasizing the collective responsibility to enhance the probation system’s response to domestic violence offenders.
