Elon Musk Sues OpenAI CEO for $150B

In a legal battle involving two billionaires, Elon Musk, the wealthiest individual globally, has accused OpenAI CEO Sam Altman of appropriating a “charity” and is advocating for Altman’s removal from the company’s leadership.

Closing statements concluded recently in Oakland, California, and a jury will commence deliberations on Monday, with U.S. District Judge Yvonne Gonzalez Rogers set to make the final ruling in a lawsuit alleging that OpenAI violated its founding agreement by transitioning into a for-profit entity. Musk is seeking $150 billion US in damages.

The outcome of the court’s decision is anticipated to have a significant impact on the AI market, as stated by Ebrahim Bagheri, a specialist in responsible AI development at the University of Toronto. According to Bagheri, the transformative potential and profitability of generative AI technology were not entirely foreseeable at OpenAI’s inception.

“A restructuring at OpenAI could not only affect the services provided by OpenAI but also impact services offered by numerous other major corporations like Microsoft,” Bagheri remarked.

Throughout the trial, numerous affluent figures from Silicon Valley took the witness stand, while protestors outside the courthouse directed their discontent towards both parties.

“It appears that, for those observing this trial, the desire is for all parties to suffer negative consequences,” stated Catherine Bracy, CEO of TechEquity, an organization dedicated to addressing tech industry-induced inequalities.

‘The fate of civilization’

Founded in 2015 as a non-profit by Musk, Altman, and others, OpenAI has transitioned into a for-profit enterprise set to go public with a $1 trillion US valuation. Musk aims to revert OpenAI to a non-profit status and remove its president, Greg Brockman, who holds a $30 billion US stake in the company.

Musk has accused OpenAI of coercing him into providing $38 million US and receiving billions of dollars from Microsoft and other investors. He is pursuing approximately $150 billion US in damages from both OpenAI and Microsoft, to be remitted to OpenAI’s non-profit division.

An email exchange from February 2023, revealed as evidence prior to the trial, showcased a significant rift between Musk and Altman.

Following Musk’s acknowledgment as his “hero,” Altman’s statement that “I don’t think OpenAI would have happened without you — and it really [expletive] hurts when you publicly attack OpenAI” led to a dramatic exchange.

In response, Musk emphasized, “I hear you, and it is certainly not my intention to cause harm, for which I apologize, but the fate of civilization is at stake.”

In a separate text exchange with Brockman proposing a potential resolution, Musk cautioned that the trial would render Brockman and Altman “the most despised individuals in America.”

Musk’s intentions have been scrutinized, as his for-profit AI company, xAI, is contemplating an initial public offering as part of SpaceX, potentially indicating a financial incentive to eliminate a competitor.
