“Canada Unveils Protecting Victims Act Against Sexual Violence”

The Liberal government has introduced comprehensive new legislation aimed at safeguarding victims and survivors of sexual and intimate partner violence while also shielding children from predators. Referred to as the Protecting Victims Act, the government views this bill as a significant overhaul of the Criminal Code, challenging a 2016 Supreme Court ruling that allows cases to be halted due to significant delays.

The proposed legislation includes heightened penalties for sexual offenses such as the dissemination of intimate images, sexual deepfakes, and soliciting sexual services from minors. Justice Minister Sean Fraser, speaking in Ottawa, emphasized the importance of safeguarding vulnerable children from exploitation and addressing violence against women, including potentially lethal situations.

The Protecting Victims Act seeks to reinstate mandatory minimum sentences, previously deemed unconstitutional by various courts, by providing limited discretion to judges within a reasonable hypothetical scenario framework. This approach aims to ensure that mandatory minimum sentences comply with constitutional standards moving forward.

Under the new legislation, courts would have the flexibility to impose lighter sentences in certain cases requiring imprisonment, except for severe offenses like murder or treason where life imprisonment is mandated. The bill aims to reinstate all mandatory minimum sentences that have been invalidated by the courts, excluding those repealed by Parliament.

Bill C-16 proposes the reintroduction of mandatory minimum penalties for individuals convicted of various sexual offenses involving children, such as possessing or accessing child sexual abuse material. These revisions follow a recent Supreme Court ruling deeming a one-year mandatory minimum sentence unconstitutional in specific cases involving child exploitation imagery.

Furthermore, the legislation addresses issues related to online safety for children by targeting offenses like sextortion and online grooming. It criminalizes threats to distribute child abuse or intimate images and enhances measures to prosecute individuals exploiting children internationally.

In the context of intimate partner violence, the bill categorizes hate-motivated murder as a first-degree offense, even if unintended or unplanned. It also recognizes femicide as first-degree murder if it can be proven that the victim experienced a pattern of abuse or coercive control.

The Protecting Victims Act aims to prevent abusive behavior patterns through a new offense and updates laws concerning revenge porn. Additionally, the legislation addresses trial delays, providing clear guidelines for courts dealing with delays, especially in sexual assault cases, to prevent unnecessary stays due to prolonged legal processes.

To enhance victim testimony, the bill proposes stricter regulations on defense attorneys obtaining alleged victims’ therapeutic records and expands access to testimonial aids without requiring prior court approval. These measures align with recommendations to improve the legal system’s treatment of victims of sexual abuse and intimate partner violence.
